While we believe there is still a place for rights-managed images, with its myriad of pricing options for different uses, the market demand and trend is clearly for the simpler pricing models. We intend to adapt as these new, fast-evolving pricing models emerge, The type of purchasing availability is indicated under the thumbnail by the following colour codes -

Our Version of Rights Managed and Royalty Free
For now we offer our version of the Royalty Free and Rights Managed models (subject to our Terms and Conditions). Please note that the terms Royalty Free and Rights Managed are industry generalisations, there are no absolute trade or legal definitions, and we define here, and in our Terms and Conditions what they mean when you buy from us. Just because another library implements the terms in a different way does not mean that their definitions hold for us.

However the copyright of our images is protected in an absolute way by law, and is not subject to interpretation. Copyright of the image always remains with the photographer or artist. Purchasing the license does not transfer this copyright to you; what you are purchasing is the right to use the image in certain specific ways and nothing more.

The ‘End User’ Principle Applies (No further rights beyond those purchased)
Purchase from Cumbria Picture Library defines you as the End User irrespective of whether you buy under the RF or RM model. Resale of the image to a third party is absolutely prohibited You may not ‘sell it on’, or give rights in it to anyone else. Copyright of the original image or painting remains with the photographer or artist (please see Copyright of Images below). You may not claim that the image is your own and you may not sell, license for use, or in any way distribute the image for reuse. Examples of permitted and non-permitted use are given below.

Royalty Free Licence
Price depends purely on the file size required, and you may use the image as often as you like as the End User. However, the way in which the image can be used is still controlled (defined below). You could not for instance make multiple prints for resale. Purchase does not automatically give exclusive use (i.e. the same image could be licenced to others at the same time). However, an ‘exclusivity’ option may be possible up to the point where the image sells for the first time. Please Contact us if exclusive image use is required.

Rights Managed Licence
The price depends on the type of use for which you intend to use the image, which is closely specified, and the image can only be used once, e.g. in a particular brochure, or newspaper editorial.

What you can do with the image you buy
Images may be used to make fine art prints not for resale, on websites, TV-programmes, for educational projects, in magazines, newspapers, books or booklets, covers for books, flyers, or any other advertising and promotional materials, in either printed or electronic media, as long as the item in which the image appears does not contradict any of the restrictions below. What you can’t do with the image you buy
An intention to sell or give images for free, is considered redistribution (if the image is used in an essential manner) and is not included using the Royalty Free license. Examples are web templates, greeting cards or postcards especially designed for sale, similar print-on-demand services, canvas, t-shirts, mugs, mouse pads or any other items incorporating the image in an essential manner. For uses such as this, you must have a Rights Managed Licence. For Web use, you must not use the image at a width exceeding 1024 pixels. You may not substantially alter the image.

Buying Extended Rights
If you wish to use an image in a way that is excluded above, it may be possible to purchase an Extended Licence that grants you extra rights. Contact us to discuss this.
